When we provide you with legal and related services, we are required to process your personal data. We greatly value your trust, and therefore, we handle your personal data with the highest degree of transparency, security, and accuracy, so that you can rely on us without any worries.

Below, you can familiarize yourself with the categories of data we will process, the purposes for which we process them, the duration of processing, and your rights in relation to the processing of your personal data. What do the basic terms used in this Privacy Policy mean?

The legal language surrounding data protection is not free of complexities, so we provide a glossary of some of the most basic terms here:
Personal Data: Any data or information that allows us to directly or indirectly identify you or another human being.
Special Categories of Personal Data: Personal data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, and the processing of genetic data, biometric data for the purpose of uniquely identifying a natural person, and data concerning health or sex life or sexual orientation, also known as sensitive data.
Processing: Any operation involving personal data, such as collection, recording, organization, structuring, storage, sorting, etc.
Controller: The entity that determines the purposes and means of processing personal data.
Processor: The entity that processes personal data on behalf of the controller and based on their instructions.

Who is the controller of your personal data?

At Aspire Attorneys, there are two independent attorneys: Mgr. Eleanor ŠMEJKALOVÁ, advokát, ID: 07712812, registered with the Czech Bar Association under number 19987, and Mgr. Ondřej VYBÍHAL, advokát, ID: 17067201, registered with the Czech Bar Association under number 20295. The controller of your personal data will always be the attorney responsible for providing legal services in your specific case. If both attorneys provide you with legal services, they will be jointly responsible for processing your personal data as joint controllers ("Joint Controllers"). What applies to Controllers in this document also applies to Joint Controllers.

In what activities shall this Privacy Policy apply?

This Privacy Policy shall govern any processing of your personal data that we conduct:
a) When providing the agreed-upon legal services, including communication via email or phone,
b) When fulfilling our legal obligations (e.g., maintaining and archiving case files),
c) When you contact us through our website (www.aspireattorneys.cz),
d) When necessary for the protection of the legitimate interests of the attorneys operating within Aspire Attorneys.

What legal regulations govern the processing of your personal data?

While processing your personal data, we will comply with all applicable legislation for your protection, particularly:
Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (known as the General Data Protection Regulation, GDPR), GDPR),
Act No. 110/2019 Coll., on the Processing of Personal Data.
However, in providing legal services, we are bound not only by legislation governing data protection but also by the Act on the Legal Profession and the professional bylaws of the Czech Bar Association. These regulations, among other things, impose on us the duty of confidentiality, which we, as attorneys, hold in high regard.

What personal data do we process?

During our cooperation and typically even after its termination, we will process the following categories of personal data:
Identification data (name and surname),
Contact data (email address, phone number, mailing address, permanent address, data box ID),
Bank details, and
Other personal data necessary for the proper provision of legal services, which concern you or other persons whose personal data you provide to us (e.g., birth number, ID card number, etc.).
It may also be necessary for the effective protection of your rights and interests to process special categories of data, such as your signature or data concerning your health or sexual orientation. In such cases, we will do so only to the extent strictly necessary and with the utmost sensitivity.

For what purposes do we process your data, and what authorizes us to do so?

We process personal data only to the extent necessary and only as authorized by a contract, law, or other legal regulation. The necessity of processing arises directly from the contract concluded between us at the start of our cooperation; without this processing, we simply could not provide you with legal services. If it is necessary to process special categories of your personal data for the protection of your rights and interests, we will do so exclusively for the purposes of establishing, exercising, or defending legal claims and for no other purpose.

As attorneys, in addition to our contractual obligations towards you, we must also meet duties imposed on us by law or other legal regulations. In order to meet those duties, it will generally be necessary to process your personal data as well (e.g., when maintaining a client file). These regulations include, in particular, the Act on the Legal Profession, the Archives and Records Management Act, the Act on Certain Measures Against the Legalization of Proceeds of Crime, and tax and accounting regulations.

It may happen that we will use your personal data to protect our legitimate interests, particularly in enforcing our legal claims, such as recovering claims arising from unpaid invoices.

Will your personal data be transferred to third parties or outside the Czech Republic?

To provide you with the highest quality services, we also cooperate with other entities who, among other things, process personal data for us (so-called processors). In processing your personal data, we are assisted primarily by:
Accountant and tax advisor,
Provider of the file management system PROMS,
Provider of the server for the PROMS file system, INTERNET CZ, a.s., located at č.p. 2, 384 03 Ktiš, ID: 26043319, registered in the Commercial Register maintained by the Regional Court in České Budějovice under file no. B 1245,
Microsoft, which provides OneDrive storage and Microsoft Office,
Translators, if it is necessary to translate documents in your case,
Our web specialist if you contact us through our website.
In providing legal services, your personal data will also be provided to the relevant public authorities while handling your case (e.g., in court proceedings, your personal data will be provided to the competent court, etc.).

If it is necessary to engage foreign partners in the EU/EHS during the provision of legal services, we will share your personal data with them. However, we will only transfer your personal data to countries outside the EU/EHS if the country in question meets the standards required within the EU/EHS. If the security standard in the given country is not sufficient, we will handle each case individually in cooperation with you.

How long will we process your personal data?

Each case is different, and therefore, the retention period of your personal data may also vary. However, we will process your personal data for as long as we provide you with legal services and subsequently for the period required by specific legal regulations, particularly the Act on the Legal Profession, the Archives and Records Management Act, the Act on Certain Measures Against the Legalization of Proceeds of Crime, and tax and accounting regulations.

We will also retain your personal data to protect our legitimate interests, such as enforcing our legal claims or resolving any disputes.

Did you contact us through our website?

If you use our contact form on the website to ask us a question or request our services, we will process your name, surname, email address, and other personal data contained in the text you send.

We will process this data for the purpose of negotiating the conclusion of a legal services agreement. If no contract is concluded, your personal data will be deleted after our communication is completed. Otherwise, further processing will be governed by this Privacy Policy as described in this document.

What rights do you have regarding how we process your personal data?

Right of Access: You have the right to request confirmation from us whether your personal data is being processed or not, and you can also ask about the purpose of the processing, what personal data we process, the planned duration of processing, and who the recipients of your personal data are. You also have the right to receive a copy of your personal data, with the first provision being free of charge, but we may charge a reasonable fee for additional copies to cover administrative costs, amounting to 100 CZK.

Right to Rectification: You also have the right to request that we correct any inaccurate or incomplete personal data concerning you. If any of your data changes, we would appreciate it if you would inform us of your current data. We may periodically ask you for updated information to ensure accuracy.

Right to Data Portability: You have the right to request that we provide your data in a machine-readable form either directly to you or to another controller according to your wishes. However, we may not always be able to fully comply with your request due to confidentiality obligations.

Right to Erasure: You can also request the deletion of personal data that is no longer necessary for the purposes for which it was originally processed or if it has been processed unlawfully. However, we may not always be able to meet your request for deletion, as we are obliged to keep records of the legal services provided in the form of a client file. If we cannot comply with your request, we will inform you.

Right to Restrict Processing: In case of disputes regarding the processing of your personal data, you have the right to request that we restrict processing of your personal data until the issue is resolved, meaning your data will only be stored and used with your consent or for establishing, exercising, or defending legal claims.

Right to Object to Processing: If we process your personal data for the protection of our legitimate interests, you have the right to object, after which we will cease processing your personal data unless it is demonstrated that we have compelling legitimate grounds for further processing that override your interests or rights and freedoms. Such a reason may include processing for the possible enforcement of our legal claims.
